Koreans centered around the Pyeongtaek peace activists and residents have been in a legal battle since April 29, 2010 when about 200 people filed a lawsuit against the Minister of National Defense, ‘demanding the cancellation of approval for the construction of a second runway (국, 영문) at the U.S. air base in Osan’ near Pyeongtaek and accusing ‘the Korean government of approving the U.S. air base's runway expansion project without conducting an environmental impact assessment or consulting the local municipal authority or residents.’ (See the Yonhap News, May 1, 2010). According to a recent email by Mr. Kang San-Won, Director of the Pyeongtaek Peace Center, the Ministry of National Defense, ROK said since the land had already been provided to the United States Forces of Korea, domestic laws could not be applied while the ROK-US Status of Forces Agreement stated that it only respected the Korean domestic laws and it was not mandatory [to apply the laws in the construction of the runway in the USFK bases].

Otherwise, the United States, after examining [the documents], has sent him a reply that it cannot go through the environmental impact assessment and only sent him the title of the law, EXECUTIVE ORDER12114, to look for it and Mr. Kang Sang-Won had to search it himself in the web. According to Mr. Kang Sang-Won, The Osan base, namely the Pyeongtaek US AFB is where the 7th Air Force Headquarter under the US Asia Pacific Command is stationed, is the core facility of the US military, occupies the 9,613,000㎥ land, similar to the area size of Yoido and about 7,000 US military and civilian are stationed there.

The expansion of the Pyeongtaek USFK base has gathered the activists' attention again in the sense that the controversial runway construction is suspected to serve to the aim of the United States military that wants to use the Korean peninsula as its out post to the overseas invasion such as Iraq and Afghanistan. Below is Pyeongtaek Peace Center's opinion regarding the problems of the 2nd runway. Sorry that it is only Korean now.

[기고_평택시민신문]평택시민은 안중에 없는 미공군 제2활주로 건설 2010-09-10

미군기지 확장으로 큰 진통을 앓았던 평택.
상처가 채 아물지도 않았는데 평택미공군기지(K55/OsanAirBase)내 제2활주로 건설계획이 발표되면서 평택은 또다시 술렁이고 있다.

주한미군이 추진하고 있는 평택미공군기지 제2활주로 건설 사업은 숱한 문제점을 안고 있다.
우선. 주민피해에 대해서는 단 한 줄도 언급하지 않고 있는 점이다.

평택미공군기지 인근지역 주민들은 지난 60년간 전투기 소음으로 이루 말할 수 없는 피해를 받아왔다. 특히 활주로에 인접해있는 마을의 소음도는 심각한 수준이다. 활주로가 추가로 건설되면 소음은 더욱 증가할 것이며 소음피해 지역 또한 확대된다. 또한 활주로 건설로 비행안전구역이 확대되어 각종 개발행위들이 제한받아 재산권도 침해받게 된다. 뿐만 아니라 활주로간의 안전거리규정도 지키지 않은 채 공사가 강행되고 있다.

둘째. 아무리 국책사업이라 하지만 평택시민의 삶과 미래에 중대한 영향을 미치게 될 중차대한 문제를 협의 하기는 커녕 통보조차 하지도 않았다.

셋째. 미군기지이전협정과 국내법을 송두리째 위반하고 있다.
제2활주로가 들어설 부지는 오래전 주한미군측에 공여된 부지라고 하지만, 제2활주로 예정부지에 설치되어있는 패트리어트 등을 옮기기 위한 대체부지는 지난 2004년 12월 발효된 ‘대한민국과 미합중국간의 연합토지관리계획협정에 관한 개정협정(연합토지관리계획협정)’에 의해 안전지역권으로 공여된 부지이다.

안전지역권은 각종 폭발물로부터 주민들의 생명과 재산을 보호하기위해 마련되었으나 안전지역권에 또 다른 위험시설을 설치하겠다는 것은 명백한 연합토지관리계획협정 위반행위다. 뒤늦게 안전지역권 변경을 위해 한미간의 협상이 진행하고 있지만 국방부는 평택미공군기지 제2활주로 건설 사업을 2008년 9월 연합방위력증강사업으로 확정하고 2009년에만 60억원을 지출하였다. 절차상으로 ‘개정협정→연합방위력증강사업으로 확정→예산지출’이 되어야 하지만 ‘연합방위력사업으로 확정→예산지출→개정협정’으로 진행되고 있는 것이다.

한미SOFA협정문에도 대한민국의 환경법, 규정 및 기준을 존중하겠다고 명시되어있고 ‘환경영향평가법률’에도 국방·군사시설의 설치사업도 환경영향평가를 실시하여야 하며 국방·군사시설은 대한민국에 주둔하는 외국군대의 부대(部隊)시설과 군사목적을 위하여 필요한 시설을 포함한 국방·군사시설의 설치·이전 및 변경에 관한 사업 등이라고 규정하고 있음에도 ‘존중’만 하면 될 뿐 ‘의무’는 아니라며 국내법을 무시하고 공사를 강행하고 있다.

최근 평택미공군기지 인근지역 주민 200명이 ‘연합방위력증강사업 무효처분소송’을 제출하면서 주민들의 저항이 본격화되고 있다.

주한미군은 현재 사용하고 있는 활주로가 노후되었다는 이유를 내세워 국민들의 귀를 현혹시키고 있지만, 평택미공군기지를 통해 동북아시아 등 미국이 필요로 하는 지역과 국가에 해외주둔 미군을 자유롭게 이동시킬 수 있는 ‘주한미군의 전략적유연성’의 실현을 위해 기반을 마련하기 위한 것이 이 문제의 본질임을 알고 있다.

결국 평택미공군기지 제2활주로건설 사업을 막기 위한 주민들의 투쟁은 주민들의 평화적 생존권을 지키기 위한 투쟁일 뿐만 아니라 한반도의 미래를 결정지을 중요한 문제가 될 것이다.
